Definitions and Interpretation

1. In this agreement, unless the context otherwise states: the "Seller" is My Natural Blends ABN 67 475 424 480.

2. The “Purchaser” means that person, firm, company or body which or whom has ordered goods from My Natural Blends;

3. The “goods” means any item or items of products of My Natural Blends;

4. Headings are for convenience only and shall not affect the interpretation of this agreement.

 

Delivery, Freight, Risk, Duties and Returns

1. The goods shall be at the risk of the Purchaser from the date of acceptance of any order by My Natural Blends and are not subject to sale and return in any circumstance.

2. My Natural Blends shall deliver the goods to the Purchaser using its nominated freight company at the cost of $9.95 Flat Rate Australiawide.

3. My Natural Blends will not be responsible for any damage to goods during transit whilst all care will be made in packing the items.

4. The Purchaser warrants that the goods are for private use not for re-sale unless otherwise agreed. My Natural Blends makes no representations that the goods comply with all laws governing sale of the goods in the country to which the goods are sent.

 

Reservation of Title

1. Until payment has been made ownership of the goods shall remain with My Natural Blends.

 

Manner of Payment

1. The Purchaser shall pay the price in full at the time of placing the order.

2. Payment will be deemed not to have been made until the funds therefore have been cleared by My Natural Blends' bankers.

     

Cancellation

1. In the event goods have not been dispatched within 30 days of the scheduled date of delivery, the order for such goods may be cancelled by the Purchaser.

2. Goods may only be returned under Returns and Cancellations.

 

Force Majeure

1. My Natural Blends shall not be liable for any loses occasioned by any cause not within its control and able to be avoided by the exercise of reasonable diligence.

 

Warranties

1. My Natural Blends hereby excludes all liability for any loss, damage, death or injury of any kind whatsoever occasioned by the Purchaser in respect of the supply of the goods including direct, indirect, consequential or inconsequential loss, damage or injury of any kind whether due to the negligence of My Natural Blends or otherwise.

 

Proper Law

1. This agreement shall be governed by and construed in accordance with the laws of the State of Queensland and the parties hereby submit to the jurisdiction of the Courts of such State.

 

Entire Agreement

1. These terms and conditions comprise the whole of the agreement between the parties with respect to the sale of the goods.

 

No Waiver

1. No failure to exercise or delay in exercising any right or remedy on the part of the Company shall operate as a waiver nor shall any exercise or partial exercise of any right or remedy preclude any further exercise of any such right or remedy.

 

Returns and Cancellations

1. Orders accepted by My Natural Blends may only be cancelled by the purchaser in the event goods have not been dispatched within 30 days of the scheduled date of delivery.

2. You may return or exchange "new and unused" merchandise if it arrives damaged or defective no later than 7 business days of receipt. On a case by case basis, we will cover shipping charges upon our receipt of the defective or missed delivered item which must be returned fully intact with the original packaging.

3. If you receive your delivery and extensive damage to the carton is obvious, refuse the order and contact customer service immediately. Please have your order number available when you contact customer service.

4. The returned merchandise must be accompanied by proof of purchase as well as all original documentation.

5. If the Goods are returned to My Natural Blends because there is no access to the premises or the Customer has failed to respond to cards left advising delivery awaited, then the costs of such return will be to the account of the customer, as well as any re-delivery cost.
